NAVAL BREACHES RESULTING IN GAOL TERMS

 Extracts from the Campbell Street Gate-book

Naval Breaches covers offences that were mainly dealt with on board the ship itself by the Captain and his officers. When found guilty the seaman in question was sentenced to a term of imprisonment in a gaol at the next port of call.  Elements of the British Navy that operated in Australian waters in the 1870s–90s were known as the ‘flying squadron’ and the vessels and crew frequently visited Sydney, Melbourne and Hobart.

 

‘Breaching the Naval Discipline Act’ was perhaps the most common offence recorded.  Others included ‘desertion’ and ‘assaulting officers’.  While on shore leave in Hobart those sailors who committed an offence were charged at the Police Office, Hobart.  On being found guilty the sailor concerned was sentenced to a term of imprisonment in Campbell Street Gaol.   In many instances sentences were not completed as sailors were escorted back to their ship when due to sail.  Presumably each convicted sailor’s sentence continued at the next port of call. As with ‘Maritime Misdemeanours’, the term ‘Breaching the Naval Discipline Act’ does not specify the particular offence with which the sailor was charged.

Gaol terms varied from twenty-four hours to eighteen months.  The gate-book describes the sailors as mainly being free convicts but it would be safe to assume many were British.  Once again the term ‘free convict’ appears to have been loosely used, applying to seamen both from interstate and overseas.  Native-born is another term which fits into the same category and could apply to any person born in either Tasmania or interstate.  It will be noted that in most cases sailors arrived at CSG the day of their sentence.

ANTRIZEL; Charles

Charles arrived in Hobart aboard HMS Wolverine.  He had been found guilty aboard ship, 5 February 1881 of Breaching the Naval Discipline Act and sentenced to 28 Days.  His warrant number 13763.  He arrived at CSG two days later when shown as 39 years-old, a seaman, Protestant with no prior convictions and illiterate.  Charles was released to his ship, 4 March.  There is no further information. 

BAGSHAW; Charles

Charles arrived in Hobart aboard HMS Dart.  He had been found guilty aboard ship, 7 February 1884 of Breaching the Naval Discipline Act and sentenced to 21 Days without Hard Labour.  His warrant number 15156.  He arrived at CSG the same day when shown as 21 years-old, a seaman, Catholic with no prior convictions and literate.  Charles was released to his ship, 23 February.  There is no further information. 

BARBER; Henry

Henry arrived in Hobart aboard HMS Sappho.  He had been found guilty aboard ship, 7 February 1884 of Breaching the Naval Discipline Act and sentenced to 56 Days.  His warrant number 12279.  He arrived at CSG the same day when shown as 20 years-old, a seaman, Protestant with no prior convictions and literate.  Henry was released to escort, 11 March.  There is no further information. 

BARDER; John

John arrived in Hobart aboard HMS Diamond.  He had been found guilty aboard ship, 21 January 1884 of Breaching the Naval Discipline Act and sentenced to 42 Days.  His warrant number 15122.  He arrived at CSG the following day when shown as 25 years-old, a marine, Protestant with no prior convictions and literate.  John was released to escort, 1 March.  There is no further information. 

BECKETT; Henry

Henry arrived in Hobart aboard HMS Orlando.  He had been found guilty aboard ship, 28 February 1890 of Breaching the Naval Discipline Act and sentenced to 42 Days.  His warrant number 18194.  He arrived at CSG 1 March when shown as a seaman, Protestant with no prior convictions and literate.  No age is shown.  Henry was released 10 April.  There is no further information. 

BIGNALL; William

William arrived in Hobart aboard HMS Nelson.  He had been found guilty at Hobart, 17 January 1884 of Disturbing the Peace and sentenced to One Month.  His warrant number 15116.  He arrived at CSG the same day when shown as 22 years-old, a seaman, Protestant with no prior convictions and literate.  William was escorted to his ship the same day.  There is no further information. 

BRENT; Henry

Henry arrived in Hobart aboard HMS Sapphire.  He had been found guilty at Hobart, 3 April 1884 of being Drunk and Disorderly and sentenced to Seven Days.  His warrant number 15255.  He arrived at CSG the same day when shown as 25 years-old, a seaman and literate.   No religion or prior convictions are shown.  Henry was released 9 April.

Henry was back before the court in Hobart, 22 July 1886 when found guilty of Disturbing the Peace and sentenced to 14 Days.  His warrant number 16347. He arrived at CSG the same day when now shown as Protestant with three or more prior convictions.  Henry was released the same day after a fine was paid.  There is no further information. 

BURGESS; Robert

Robert arrived in Hobart aboard HMS Nelson.  He had been found guilty aboard ship, 23 February 1884 of Desertion and sentenced to One Year.  His warrant number 15199.  He arrived at CSG two days later when shown as 24 years-old, a bandsman, Protestant with no prior convictions and literate.  Robert was escorted to his ship, 7 March.  There is no further information. 

BURROWS; Alfred

Alfred arrived in Hobart aboard HMS Nelson.  He had been found guilty aboard ship, 27 December 1883 of Breaching the Naval Discipline Act and sentenced to 30 Days.  His warrant number 15084.  He arrived at CSG the same day when shown as 27 years-old, a seaman, Protestant with no prior convictions and literate. Alfred was released 26 January.

A search of BDM records show an Alfred Henry Burrows married a Mary Mosley at Sheffield, 8 January 1889.  He is shown as 33 years-old and Mary, 21 years-old.  There is no further information. 

BURTON; William

William arrived in Hobart aboard HMS Dart.  He had been found guilty at Hobart, 19 May 1888 of Obscene Language and sentenced to One Month.  His warrant number 17197.  He arrived at CSG the same day when shown as 20 years-old, a seaman, Protestant with no prior convictions and literate.  William was released the same day after a fine was paid.  There is no further information. 

BYRNE; William

William arrived in Hobart aboard HMS Diamond.  He had been found guilty aboard ship, 22 January 1884 of Breaching the Naval Discipline Act and sentenced to 28 Days.  His warrant number 15125.  He arrived at CSG the following day when shown as 20 years-old, a seaman, Catholic with no prior convictions and literate.  William was released to his ship, 19 February.  There is no further information. 

CARTER; Charles

Charles arrived in Hobart aboard HMS Diamond.  He had been found guilty aboard ship 22 January 1884 of Breaching the Naval Discipline Act and sentenced to 42 Days.  His warrant number 15123.  He arrived at CSG the following day when shown as 19 years-old, a seaman, Protestant with no prior convictions and literate.  Charles was released to escort, 1 March.  There is no further information. 

CARTEUR; Edward

Edward arrived in Hobart aboard HMS Egeria.  He had been found guilty at Waratah of Desertion (date not shown) and remanded in custody.  His warrant number 17666.  He arrived at CSG 10 April 1889 when shown as 20 years-old, a seaman, Protestant with no prior convictions and literate.  Edward was released to escort, 22 April.  There is no further information. 

CHARLICK; W. J.

W. J. arrived in Hobart aboard HMS Sapphire.  He had been found guilty aboard ship 29 October 1877 of Breaching the Naval Discipline Act and sentenced to 21 Days.  His warrant number 12118.  He arrived at CSG the following day when shown as 19 years-old, a seaman, Protestant with no prior convictions and literate.  He was released to his ship, 15 November.  There is no further information. 

COLE; Peter

Peter arrived in Hobart aboard HMS Nelson.  He had been found guilty aboard ship, 4 February 1884 of Desertion and sentenced to 18 Months.  His warrant number 15147.  He arrived at CSG two days later when shown as 27 years-old, a labourer, Protestant with no prior convictions and literate.  Peter was released to escort, 7 March.  There is no further information. 

CONNORS; Isaac

Isaac arrived in Hobart aboard HMS Hero.  He had been found guilty at Hobart 21 October 1879 of Assaulting Constable Peters and sentenced to One Month.  His warrant number 13105.  He arrived at CSG the same day when shown as 20 years-old, a seaman, Catholic with no prior convictions and illiterate.  Isaac was released two days later after a fine was paid.  There is no further information. 

CONNORS; James

James arrived in Hobart aboard HMS Hero.  He had been found guilty at Hobart 26 April 1880 of being Drunk and sentenced to Seven Days.  His warrant number 13405.  He arrived at CSG the same day when shown as 20 years-old, a seaman, Catholic with one prior conviction and literate.  James was released 1 May.

A search of BDM records show a person of this name born at Port Sorell, 2 September 1860.  The records also show a marriage to a Catherine Hays at Port Sorell, 6 August 1883.  He is shown as 24 years-old and Catherine, 26 years-old.  There is no further information. 

COTTERILL; John

John arrived in Hobart aboard HMS Egeria.  He had been found guilty aboard ship 10 January 1888 of Breaching the Naval Discipline Act and sentenced to 28 Days.  His warrant number 17047.  He arrived at CSG the same day when shown as 18 years-old, a seaman Protestant with no prior convictions and could only read. John was released 7 February.

On 8 March 1888 John was found guilty aboard ship of again breaching the Act and sentenced to another 28 Days.  His warrant number 17109.  He arrived at CSG the same day when now shown as literate.  John was released to his ship, 3 April.  There is no further information. 

DARLING; Charles Henry

Charles arrived in Hobart aboard HMS Emerald.  He had been found guilty aboard ship 31 January 1882 of Breaching the Naval Discipline Act and sentenced to 42 Days.  His warrant number 14186.  He arrived at CSG the same day when shown as 20 years-old, a seaman, Protestant with three or more prior convictions and literate.  Charles was released to escort, 3 March.  There is no further information. 

DAVISON; Edward

Edward arrived in Hobart aboard HMS Diamond.  He had been found guilty aboard ship 29 January 1884 of Breaching the Naval Discipline Act and sentenced to 42 Days.  His warrant number 15136.  He arrived at CSG the same day when shown as 21 years-old, a seaman, Protestant with no prior convictions and literate.  Edward was released to escort, 8 March.  There is no further information.

DIXON; James

James arrived in Hobart aboard HMS Egeria.  He had been found guilty aboard ship, 30 January 1888 of Breaching the Naval Discipline Act and sentenced to 14 Days.  His warrant number 17075.  He arrived at CSG the same day when shown as 19 years-old, a seaman, Protestant with no prior convictions and literate.  James was released 14 February.  There is no further information. 

DYKE; John

John arrived in Hobart aboard HMS Diamond.  He had been found guilty aboard ship, 16 January 1883 of Breaching the Naval Discipline Act and sentenced to 42 Days.  His warrant number 14660.  He arrived at CSG the following day when shown as 25 years-old, a barber, Protestant with no prior convictions and literate.  John was released 24 February.  There is no further information. 

ELDRED; Harry P.

Harry arrived in Hobart aboard HMS Egeria.  He had been found guilty aboard ship, 5 February 1889 of Breaching the Naval Discipline Act and sentenced to 28 Days.  His warrant number 17568.  He arrived at CSG the same day when shown as 21 years-old, a seaman, Protestant with no prior convictions and illiterate.  Harry was released 4 March.  There is no further information. 

EYRE; Frederick E.

Frederick arrived in Hobart aboard HMS Nelson.  He had been found guilty aboard ship, 27 December 1883 of Breaching the Naval Discipline Act and sentenced to 30 Days.  His warrant number 15085.  He arrived at CSG the same day when shown as 27 years-old, a seaman, Protestant with no prior convictions and illiterate.  Frederick was released 26 January 1884.  There is no further information. 

FEATHERSTONE; Francis

Francis arrived in Hobart aboard HMS Penguin.  He had been found guilty aboard ship, 15 December 1890 of Breaching the Naval Discipline Act and sentenced to 28 Days.  His warrant number 18651.  He arrived at CSG the same day when shown as 26 years-old, a seaman, Protestant with no prior convictions and illiterate.  No release date is shown.  There is no further information. 

FELTON; Henry

Henry arrived in Hobart aboard HMS Nelson.  He had been found guilty aboard ship, 4 February 1884 of Desertion and sentenced to 15 Months.  His warrant number 15148.  He arrived at CSG the same day when shown as 24 years-old, a labourer, Protestant with no prior convictions and literate.  Henry was released to escort, 7 March.  There is no further information. 

FISHER; Charles Richard

James arrived in Hobart aboard HMS Nelson.  He had been found guilty aboard ship, 25 February 1884 of Desertion and sentenced to Twelve Months and dismissed from the Navy.  His warrant number 15134.  He arrived at CSG the same day when shown as 37 years-old, an engine smith, Protestant with no prior convictions and literate.  James was released to escort, 7 March.

A search of BDM records show a person of this name possibly married a Sarah Jones at Oatlands, 3 September 1870.  He is shown as 25 years-old and Sarah, 22 years-old. There is no further information. 

GALWAY; Charles

Charles arrived in Hobart aboard HMS Sapphire.  He had been found guilty at Hobart, 2 January 1884 of Breaching the Naval Discipline Act and sentenced to 14 Days.  His warrant number 15094.  He arrived at CSG the same day when shown as 18 years-old, a seaman, Catholic with no prior convictions and literate.  Charles was released to his ship, 7 January.  There is no further information.

KENNERLEY; Marcus

Marcus arrived in Hobart aboard HMS Wolverine.  He had been found guilty aboard ship, 2 January 1881 of Breaching the Naval Discipline Act and sentenced to 28 Days.  His warrant number 13715.  He arrived at CSG the following day when shown as 26 years-old, a soldier, Protestant with no prior convictions and literate. Marcus was released 29 January.  There is no further information.

LANGDON; Martin

Martin arrived in Hobart aboard HMS Nelson.  He had been found guilty at Hobart, 17 July 1888 of Assaulting Police and sentenced to One Month.  His warrant number 17239.  Martin arrived at CSG the same day when shown as 36 years-old, a fitter, Protestant with no prior conviction and literate.  He was released 16 August.

On 27 December 1888 Martin was found guilty of Wife Beating and Larceny and sentenced to Two Months on the first charge and remanded on the other.  His warrant numbers 17510-11.  He arrived at CSG the same day and was apparently released 5 January after a fine was paid.

A search of BDM records show a person of this name married an Eliza Jane Green at Hobart, 24 January 1885.  Both are shown as 32 years-old.  There is no further information. 

LEATHER; Thomas

Thomas arrived in Hobart aboard HMS Rapid.  He had been found guilty aboard ship, 21 February 1890 of Breaching the Naval Discipline Act and sentenced to 21 Days.  His warrant number 18177.  He arrived at CSG the same day when shown as 20 years-old, a seaman, Protestant with no prior convictions and literate.  Thomas was released to his ship, 13 March.  There is no further information. 

LEMM; Thomas W.

Thomas arrived in Hobart aboard HMS Miranda.  He had been found guilty aboard ship, 10 February 1886 of Breaching the Naval Discipline Act and sentenced to 90 Days.  His warrant number 16081.  He arrived at CSG the same day when shown as 20 years-old, a seaman, Protestant with no prior convictions and literate. George arrived in Hobart aboard HMS Miranda.  He had been found guilty aboard ship, 22 February 1881 of Breaching the Naval Discipline Act and sentenced to 14 Days.  His warrant number 13784.  He arrived at CSG the same day when shown as 21 years-old, a soldier, Protestant with no prior convictions and literate.  George was released to escort, 8 March.

A search of BDM records show a George Page was born Glamorgan, 9 September 1860.  The records also show a person of this name married an Eliza Macrow at Port Sorell, 25 December 1880.  He is shown as 20 years-old and Eliza, 17 years-old.  There is no further information.

Joseph arrived in Hobart aboard HMS Nelson.  He had been found guilty aboard ship, 6 February 1884 of Desertion and sentenced to 15 Months.  His warrant number 15151.  He arrived at CSG two days later when shown as 26 years-old, a painter, Catholic with no prior convictions and literate.  Joseph was released to escort, 7 March.

A search of BDM records show a person of this name possibly married a Susan Walker at Hobart, 17 May 1880.  Both are shown as adults. There is no further information.

PEACEY; George

George arrived in Hobart aboard HMS Miranda.  He had been found guilty aboard ship, 4 February 1884 of Insubordination and sentenced to Nine Months.  His warrant number 15157.  He arrived at CSG three days later when shown as 27 years-old, a seaman, Protestant with no prior convictions and literate. George was released to escort, 7 March.  There is no further information.

PEARSON; Frederick

Frederick arrived in Hobart aboard HMS Wolverine.  He had been found guilty aboard ship, 10 January 1880 of Breaching the Naval Discipline Act and sentenced to 28 Days.  His warrant number 13249.  He arrived at CSG a week later when shown as 22 years-old, a seaman, Protestant with no prior convictions and literate. George arrived in Hobart aboard HMS Nelson.  He had been found guilty aboard ship, 11 February 1884 of Desertion and sentenced to 18 Months.  His warrant number 15180.  He arrived at CSG two days later when shown as 21 years-old, a seaman, Protestant with no prior convictions and literate.  George was released to escort, 7 March. SAYER; John Samuel

Thomas apparently arrived in Hobart aboard the Danae.  It appears he was arrested and found guilty aboard ship on 15 January 1880 of Desertion from HMS Emerald.  He was sentenced to 90 Days.  His warrant number 13255.  He arrived at CSG the following day when shown as 19 years-old, a seaman, Protestant with no prior convictions and literate.  No release day is shown.  There is no further information. 

SHELLY; William Frederick

William arrived in Hobart aboard HMS Emerald.  He had been found guilty aboard ship, 17 February 1882 of Desertion and sentenced to 90 Days.  His warrant number 14211.  He arrived at CSG the same day when shown as 26 years-old, a seaman, Protestant with no prior convictions and literate.  William was escorted to Sydney, 27 April. TALBOT; Alfred E.

This sailor arrived in Hobart aboard HMS Sapphire.  He had presumably been found guilty aboard ship, 1 September 1881 of Breaching the Naval Discipline Act.  For some unexplained reason he was given the option of Freedom to join the Constabulary which he accepted.  However, he is shown resigning, 8 January 1882. There is no further information. 

TUNNY; Hugh

Hugh arrived in Hobart aboard HMS Nelson.  He had been found guilty aboard ship, 4 February 1884 of Desertion and sentenced to Two Years.  His warrant number 15152.  He arrived at CSG two days later when shown as 25 years-old, a seaman, Catholic with no prior convictions and literate.  Hugh was released to escort, 7 March. There is no further information. 

TURTCHETT; Joseph

Henry arrived in Hobart aboard HMS Rambler.  He had been found guilty aboard ship, 27 February 1890 of Breaching the Naval Discipline Act and sentenced to 14 Days.  His warrant number 18189.  He arrived at CSG the following day when shown as 33 years-old, a seaman, Protestant with no prior convictions and literate. Henry was released to his ship, 11 March.

A search of BDM records shows numerous marriages for the name Henry White. There is no further information. 

WHITE; Henry James

Henry arrived in Hobart aboard HMS Nelson.  He had been found guilty aboard ship, 14 March 1882 of Breaching the Naval Discipline Act and sentenced to 30 Days.  His warrant number 14282.  He arrived at CSG two days later when shown as 22 years-old, a seaman, Protestant with no prior convictions and literate.  Henry was released 13 April.

A search of BDM records shows a death for a person of this name at Hobart, 15 February 1883, when aged 23 years. There is no further information. 

WILLIAMS; Robert

Robert arrived in Hobart aboard HMS Nelson.  He had been found guilty at Hobart, 12 April 1884 of being Drunk and Disorderly and sentenced to Seven Days.  His warrant number 15279.  He arrived at CSG the same day when shown as 21 years-old, a seaman, Protestant with no prior convictions and literate.  Robert was released 18 April.

A search of BDM records shows a birth for a person of this name at Longford, 8 February 1864. There is no further information.

WILSON; Matthew

Matthew arrived in Hobart aboard HMS Nelson.  He had been found guilty aboard ship, 4 February 1884 of Desertion and sentenced to 18 Months and to be dismissed from the Ship.  His warrant number 15154.  He arrived at CSG two days later when shown as 20 years-old, a brick-maker, Protestant with no prior convictions and literate.  Matthew was released to escort, 7 March. There is no further information. 

WINCH; Alfred G.

Alfred arrived in Hobart aboard HMS Diamond.  He had been found guilty aboard ship, 16 January 1884 of Breaching the Naval Discipline Act and sentenced to 42 Days.  His warrant number 14661.  He arrived at CSG the following day when shown as 23 years-old, a baker, Protestant with no prior convictions and literate.  Alfred was released 24 February.  There is no further information.
