General Notes: A short time after the birth of Vyvyana, Mary Anne's husband went to New Zealand to "make good" Her father William Webb considered her too young and her baby daughter to go with him, and so she returned to her father's care along with the baby. It is not known what Wyndham v Gwyer did in New Zealand, or how long he was there for, but it is believed Mary Ann and his daughter did not really live with him again. He visited them and his grandchildren.
Mary Anne Gwyer made her will on the 29th of January at Ballarat Victoria. At this time it appears she was residing at No. 207 Sturt St, with George Webb (fishmonger) She must have moved about the family living with different ones after her father died. When her daughter was married , or sometime after, she went to with her and her husband Robert McGough.
She was alway's known as Aunt Mary and never grandma or grandmother. Mary Ann told different ones she still always loved Wyndham Gwyer although she had not lived with him for so long. I t is a rather sad love story with so many unanswered questions. Mary Ann is Buried in the Cornelian Bay Cemetery near all the McGough's of that branch
Informant at the birth of Mary Ann Webb was her grandmother Maria Hallam

THE COLONIST NELSON NEW ZEALAND 4.3.1916
A SHOCKING ACCIDENT
MOTOR COLIDES WITH TRAIN
TWO MEN FATALLY INJURED
ANOTHER SERIOUSLY HURT

The rail crossing at Annesbrook was the scene of a shocking accident yesterday afternoon. A motor car , containing 4 male occupants, was proceeding from Nelson to Motueka via the Rocks road, and collided with the down town train from Belgrove due in town at 1.40pm.
The occupants of the care were Messrs F R Hallam, orchadist of Tasman P. B. Lomax, land agent of Motueka, H.D. Pine of St Albans Christchurch. And R Havlock Green of Moorhouse Ave Christchurch.
The two last named gentlemen it is understood were being taken to view some orchid properties in the Motueka district.

The car which was being driven by Mr Hallam was traveling at a fair rate of speed, and struck one of the waggons near the engine with tremendous force, swerving the car round. Whether it was the first or second waggon does not seem clear and some person's state that the car appeared to strike between the waggons.
Before this crossing is reached trains speed up in order to pull up the incline of Jenkin`s Hill, and the train was therefore traveling at a considerable accelerated pace.
The car was wrecked and the occupants were thrown out in all directions The driver it is stated, was thrown across the opening between the two waggons and landed on the Stoke side of the track . Except for some slight abrasions on the right arm, and a severe shaking, he escaped unhurt.
The others were seriously hurt, and Messrs Pine and Green sustained injuries from which they succumbed after their admission to the hospital.
It is stated that Messrs Green and Lomax were carried over the cattle stop about a chain up the line. The train was brought to a standstill, and first aid was rendered Nurse Field of Richmond and Dr Marshall a visitor to the district who were passengers on the train, Drs Lucas and Johnston were summoned, and were promptly on the scene. The injured men were made as comfortable as circumstances permitted and were brought into town in the guard van. The van was then taken back to the Hampden street crossing and the injured men were removed to the hospital
Messrs Pine and Green, being the most seriously injured, at once received the attention of the Resident Surgeon (Dr Jamieson) and Drs Lucars and Johnston. But Mr Pine, whose injuries at first were thought only to consist of a badly crushed toe, gradually sank, and died at four o`clock, probable from internal injuries, as there was a depression in the chest above the heart.

Mr Green sustained terrible injuries to the chest and abdomen, and his case from the first was regarded as hopeless. He passed away shortly before 6 o`clock.

Mr Lomax .who bore up wonderfully, in spite of his serious injuries. Had his left leg cut through below the knee bone being severed and the flesh badly crushed. He also sustained a punctured wound under the arm, and severe head wounds. When enquiries were made at the hospital at a late hour last night it was learnt that Mr Loamax`s leg was in a serious condition but that there was a chance that amputation might not be necessary.

Speaking to a relative at the Hospital last night. Mr Lomax said that he was lucky to escape with his life., and that he was being carried on the cow catcher of the locomotive when the thought flashed on his mind that he should roll off, which he did and as he put it in time to save my life but not my leg. This statement conflicts with other accounts as to the point of contact between train and car.

It is stated that the driver and fireman on the engine observed the car approaching, and whistled vigorously but, the driver of the car did not hear the warning signals until to late to pull up the car. Mr Hallam states that as soon as he observed the train he put on the brakes, but was unable to avert the accident.
The Annesbrook crossing has been the scene of several accidents.

THE COLONIST NELSON. NEW ZEALAND 16.3.1916
Criminal Business Annesbrook Fatalities
This morning Frank Rupert Hallam driver of a motor car which collided with a train At the Annesbrook crossing on Friday March 3rd 1916 will be charged with manslaughter by causing the deaths of Horace Daniel Pine and A E Havelock Green
Mr C R Fell will appear for the crown and Mr T M Wilford( Wellington) with him Mr C J Harley for the accused.

SUPREME COURT

Nelson Wednesday June 21 1916
Before Mr. Justice Hosking

CHARGE OF MANSLAUGHTER

ACCUSED ACQUITTED

Frank Rupert Hallam, was charged with having committed manslaughter by causing on March 3rd 1916, the death of Horace Daniel Pine and Arthur Edward Havelock- Green, further, with causing the deaths of the persons named by the nomission without lawful excuse to observe a legal duty when approaching a railway crossing by failing to slacken speed to a pace not exceeding 10 miles an hour: and further with causing the deaths of the persons named by failing to keep a vigilant look-out for the train.

The case was tried at the March sittings of the Supreme Court, when the jury disagreed. The following comprised the jury:---

R.A. Davidson, C.B. Harman, J.M. Stains, J.G. Cross, H.S Robinson, L.H. Graham, J.H. Edmonson, T Ross, A.T. Akehurst, G.J.White, J. Shea, and H.B. Bolton. Mr. Robinson was chosen as foreman.

Mr. C.R. Fell appeared for the crown and Mr. T.M. Wilford for the accused, who pleaded not guilty.
Mr. Fell, in opening, stated that on March 3rd last, the accused, with three other men, was driving a motor car from Nelson to Motueka. On reaching the Annsbrook crossing the car collided with the train, which was coming in the opposite direction and Messrs Pine and Green unfortunately were killed.

Clarice Erskine, who resides near the Annsbrook crossing, stated that she observed a car travelling faster than the ordinary rate towards the crossing and also saw the train coming in the opposite direction. Shortly afterwards she heard the crash.

John Morris Stevens, engine driver, gave evidence in regard to the sounding the usual whistles, and stated that when he first saw the car the engine was about 30 yards from the crossing. The car was travelling about 15 miles an hour and he expected it to stop. By His Honour. He had seen cars travelling faster than the accused toward the crossing.
Continuing: Witness said that when he saw the car was not going to stop he shut off steam and applied the brakes. The car struck the train between the first and second wagon from the engine.

Dr Jamieson gave evidence as to the injuries and deaths of the deceased.

William Wilson, guard stated that he felt the bump of the collision. He described the position of the men on the road after they had been thrown out of the car.
Henry William Schwass ganger, who arrived at the scene of the accident three quarters of an hour after it had happened, gave evidence in regard to the position of the car as it lay on the cattle stop. The brake was off.
Vincent J James Crequer, motor expert with 12 years experience, stated that when the accused car left the commercial garage the brakes were in good order. The foot brake being particularly fierce. The latter should pull up a car going 20 miles an hour in 30 ft one going 10 miles an hour in a car's length. On the day of the accident he saw the car at the Annsbrook crossing. The hand brake was off but it might have been put back either by hand or by the impact of the collision. The back tires bore evidence of the foot brake having been applied, pieces of the rubber being worn off.

Cross examined by Mr. Wilford, witness said that the accused could stop the car without
moving his hands from the wheel. The crossing at Annsbrook was the most dangerous for motors that he had ever seen. If a car pulled up a yard or so as a precaution before reaching the line it would not be possible after getting way on to get across if a train came out of the cutting from the Nelson side at 20 miles an hour.
His Honour: How should anyone ever get across then?
Mr. Wilford: I don't know. A suggestion has been made that an overhead bridge should be erected there.
Witness replying to further questions by Mr. Wilford, stated that from the damage to the lamps and the condition of the dumb irons, the car was within two ft of coming to a standstill. In his opinion the brakes were on at the time of the accident.
By Mr Fell: When the car left the garage the week before the accident the clutch was in good order.

Constable Mc Gregor put in certain measurements taken after the accident. He also related an interview he had with the accused at the Commercial Hotel after the accident. Mr. Wilford objected to witness being allowed to say what the accused had said then, contending that he was in a distressed state of mind at the time. His Honour said the evidence could be admittedfor what it was worth. Mr. Wilford could cross-examine if he desired.

Cross-Examined by Mr. Wilford, witness said that the accused was very distraught when he was questioned by witness about the accident.
The evidence of Percy Lomax. One of the occupants of the car was read.
This was the case for the Crown.
The accused then went into the witness box and gave evidence. He stated that the car was in good order, having come out of the garage, the week previously. He came to Motueka to oblige Mr. Lomax, and had no interest in the mission whatever. He knew the Annsbrook crossing was dangerous and he was once nearly run over there when on a bicycle. He knew every inch of the road, having travelled it hundreds of times. On his way out he kept a look-out on both sides for trains. The average height of the hedge along the west side of the road which obscured the view of the train was about 10ft 6 ins. Before he came to the crossing he took his foot off the accelerator to slow down, as a natural precaution, as it was impossible to see any train. When he got to within 25 yards of the crossing there was no engine in sight. The speed of the car was gradually diminishing, and he was keeping a sharp look out, when suddenly the engine appeared on the cattle stops. He released the clutch, slapped on the foot brake and reached for the hand brake.
He expected the car to stop, but some part touched the train, and that was all he remembered. Since the accident the hedge on the right hand side of the road, going out had been cut back, giving a clear view except for a house. The danger on the left hand side of the road remained.
Cross examined the accused denied that he was traveling much faster than he had stated. He was watching for danger on the cutting side.
By Mr. Wilford: If he had been going faster he would have got over the line. Charles John Harley, solicitor, stated that he knew the Annsbrook Crossing as an exceedingly dangerous one from either side. At the time of the accident there was a high hedge on the right hand side going out, except for gaps in the hedge, which one flashed past. On the left hand side the train comes out of the cutting, which is the dangerous side. He considered it more dangerous to stop when near the line and start again than to keep on. The cutting down of the hedge had improved the view, and if the hedge had been cut down at the time now in question the accident would not have occurred The accused recalled, stated that he did not hear the engine whistle.

This was the case for the defence;
His Honour asked whether Mr. Fell desired all the counts to be submitted to the jury.
Mr. Fell said he did not mind.
His Honour said that from the evidence of Mr. Harley if the railway rules were observed at this particular place they would lead into trouble.
Mr. Fell said that he would withdraw all the counts except the general issue of manslaughter. Mr Wilford then proceeded to address the jury. It was not he said, for the counsel for the defence to prove the accused innocent: It was for the Crown to find him guilty. He asked which witness for the Crown had proved that the accused did not exercise proper care. The accused had not driven at an excessive pace. If he had he would have got over the crossing. The evidence of the engine driver showed that the accused was keeping a look out and was not reckless. The accused who was driving his own car, had only remarked that morning that there would be an accident at the crossing some day. Was it likely, asked Mr. Wilford that after that the accused would be reckless and risk his own life, the life of his friend (Mr. Lomax) and the lives of the two strangers, besides his own car? It was preposterous. He invited his learned friend to point out in the evidence where negligence and callousness was shown. The jury had direction, and it rested with them absolutely to say whether the accused was guilty of negligence which caused the manslaughter. Mr. Fell said it was for the jury to say whether the accused used reasonable care and diligence.
The smash occurred, and the question was, whether the accused was responsible. He submitted that if the accused had been travelling at the pace he said he was, there would never have been any accident at all. The Crown contended that the accused had not exercised reasonable care and was therefore guilty.

His Honour, in summing up dealt with the law of manslaughter. There were he said many graduations of manslaughter, but it was not for the jury to consider them. They had to consider whether the accused took reasonable precautions in approaching the railway crossing. If they found he did not, then he was guilty, what ever the consequences. The jury had to consider what a reasonable man would do in the circumstances at that crossing. They had to consider whether the outlook demanded by the law had been kept in proportion to the extreme danger of the Annsbrook crossing. It was almost incredible to think that a man, after speaking about the crossing, was not thinking about it as he approached it. If the jury were of opinion that the accused took reasonable precautions in approaching the crossing, they would of course, find him not guilty, and if they were unable to decide whether he had taken reasonable precautions, they should give the accused the benefit of the doubt.

After 40inutes retirement the jury returned and the verdict of Not Guilty.

It was run successfully as an Orchard and exporting business.
Unfortunatley in the 1920's Apple prices fell and many orchardists found themselves with greatley reduced incomes as neither mainland nor Britian would take Tasmanian fruit.
There was great difficulty struggling to pay overdue rates and in 1923 the Council ordered the property be seized and sold for payment of back rates. The Hallams were not the only family in the district this happened to as many properties were seized and sold or subdivided into smaller sections for industrial use.

One of his best performances was that of riding 100 miles in 9hrs 9 minutes. He was contemporary of Messers A. J Golding, C. M Barlow, R. O. Bishop and A. Reynolds and represented Tasmania in important Cycling contests on the Mainland. Mr Hallam's Association with Cycling extended over more than two decades and he was prominent in the sport up until the end of last century.

Mr Hallam was a useful footballer in his day, and captained the Victoria team, a combination of Glenorchy and Newtown players. He also played with Colebrook in the Tasmanian football Association. He was a good long distance runner and won several mile races on Tasmanian Tracks.
